Quick answer

Antoine Landscape Contractors installs fibreglass, vinyl liner and concrete inground pools in Hamilton, including Stoney Creek, Dundas and Waterdown/Flamborough, along with the surrounding landscape. Hamilton needs an Enclosure Permit and sometimes a Site Alteration Permit; the lower city brings a higher water table, while the Mountain brings rock. Quotes start with a free on-site consultation.

Step by step

Your permit path in Hamilton

Hamilton treats the enclosure and any grading separately. Most of the waiting is on paperwork, not digging.

Steps to get your pool permitted

How to read this: Read left to right (top to bottom on a phone). Each numbered step must be done before the next; the times shown are the published ones where a source gives one.

  1. Ontario One Call locate

Request a free utility locate before anyone digs.

  2. Enclosure Permit

Apply to the City of Hamilton Building Division. The owner signs the Oct 2025 checklist; the fee is set by the User Fees By-law, so confirm it with the Building Division (905-546-2720).

  3. Site Alteration Permit, if triggered

By-law 19-286 applies when grade changes more than 0.2 m within 3 m of a lot line or more than 0.5 m elsewhere, a retaining wall is over 0.5 m, decking is within 0.45 m of a lot line, or drainage is obstructed.

  4. Build behind temporary fencing

Diamond-mesh temporary fencing (openings ≤38 mm) for up to 7 consecutive days unless the Director allows longer.

    Max 7 days unless extended

  5. Enclosure inspection

The permanent enclosure must pass inspection before the pool holds water.

  6. Fill

    Only after the enclosure passes.

Each step must be finished before the next one can start.

Ground and site

What's under Hamilton yards

Ground conditions from the lake to the mountain

How to read this: A side view of the ground from Lake Ontario up to the Mountain. Tap a numbered marker or the matching list item to read what the ground is like there.

Lake Ontario, lower city sand and clay, escarpment, and the Mountain with rock under till. Numbered markers match the ground conditions below.Lake OntarioLower city(sand & clay)EscarpmentThe Mountain(rock under till)12345

Simplified schematic, not to scale; ground varies lot by lot.

Soil changes from sandy clay near the lake to rock and glacial till near the escarpment, which affects how a pool is dug and built.
  • Lower city: lakebed sand and clay, with a higher water table near the lake. A fibreglass shell here needs a groundwater relief pipe and must never be drained fully.
  • The Mountain: glacial till over dolostone and limestone, where rock is the main risk. Rock excavation is a typical market add of $5,000–$20,000 (Devine Image, Apr 2026).
  • Heavy Hamilton clay can overwhelm standard equipment (Boulder Design, Feb 2026).
  • Spoil goes to an approved receiver site, and fill brought in must come from within the city.

Water

Draining and water in Hamilton

Dechlorinate to ≤0.1 mg/L (about 2 weeks without chemicals) and drain slowly onto your own lawn. Salt water goes to the sanitary drain or a licensed hauler. Fines reach up to $10,000 for a first conviction and $25,000 after.

Filling a typical 75 m³ pool costs about $377 at Hamilton's 2026 upper-block rate ($2.42 water + $2.61 wastewater per m³), or about $251 at Halton's $3.3441/m³ (Burlington, Oakville). Illustrative estimate, not a quote.

Hamilton pool FAQ

Do I need a permit for an inground pool in Hamilton?

Yes. Hamilton requires an Enclosure Permit from the Building Division before construction. The owner signs the City's October 2025 checklist, and the fee is set by the User Fees By-law, so confirm the current amount with the Building Division at 905-546-2720. A separate Site Alteration Permit may also apply if the grading triggers in By-law 19-286 are met.

How high does a pool fence have to be in Hamilton?

Hamilton's pool enclosure by-law 16-184, amended by 22-059, sets a minimum fence height of 1.5 m, with a 2.0 m maximum on the checklist. Gates must be self-closing and self-latching on the inside at 1.35 m or higher, and the enclosure must pass inspection before the pool is filled with water.

How far from the lot line can a pool go in Hamilton?

Under Zoning By-law 05-200 section 4.11, the water's edge must be at least 1.25 m from any lot line, and a pool can't sit in the required front yard. Pool pumps must be 0.6 m from the side and rear lot lines. Older former-municipality zoning still applies to some lots, so zoning is confirmed lot by lot.

When does Hamilton need a Site Alteration Permit for a pool?

By-law 19-286 applies if grade changes by more than 0.2 m within 3 m of a lot line or more than 0.5 m elsewhere, if a retaining wall exceeds 0.5 m, if decking sits within 0.45 m of a lot line, or if drainage is obstructed. Many sloped or tight Hamilton yards meet at least one of these triggers.

Can I build a fibreglass pool in Hamilton's lower city?

Yes, but plan for groundwater. Lower-city lakebed sand and clay can hold a higher water table near the lake, and a drained fibreglass shell can float when groundwater rises. A deep-end groundwater relief pipe lets water around the shell be pumped down, and the pool should never be drained fully.

Does Hamilton Mountain rock affect pool cost?

It can. The Mountain sits on glacial till over dolostone and limestone, and rock is the main excavation risk there. Rock excavation is a typical market add of $5,000 to $20,000 (Devine Image, April 2026). A test pit before design tells you how deep the pool can go and whether breakers are needed.

How do I drain a pool in Hamilton?

Dechlorinate the water to 0.1 mg/L or less, which takes about two weeks without chemicals, then drain slowly onto your own lawn. Never send it to storm sewers, streets or ravines. Salt water goes to an indoor drain on the sanitary line or a licensed hauler. Fines can reach $10,000 for a first conviction and $25,000 after.
