When do you need a deck permit in Hamilton?
The City of Hamilton's porches and decks rules apply across Hamilton (incl. Ancaster, Dundas, Stoney Creek, Waterdown, Flamborough). A permit is required for any-sized deck or porch attached to a building; a detached uncovered deck or porch greater than 10 m² and more than 200 mm above adjacent grade; a detached covered deck or porch greater than 10 m² regardless of height; and a detached deck or porch of 10 m² or less that is adjacent to or associated with a door and more than 600 mm above adjacent grade.
Replacing guards or installing new guards also requires a permit. Where no permit is needed, zoning and other regulations still apply. Hamilton Building Division: 905-546-2720.
When do you need a deck permit in Oakville?
The Town of Oakville requires a permit for decks greater than 10 m² and higher than 61 cm above adjacent grade, and for any size of deck attached to a house. All decks must comply with the zoning by-law. Contact Ontario One Call (1-800-400-2255) before digging footings.
When do you need a deck permit in Burlington?

Does my deck likely need a permit?
Answer a few questions for a quick planning indication based on the rules above. It is not a municipal decision.
If no permit is needed, can I build however I want?
No. Permit-exempt never means code-exempt. A deck that does not need a permit must still meet the Ontario Building Code and the zoning by-law.
- Guards are required where the walking surface is more than 600 mm above adjacent grade
- Footings should bear below frost depth — about 1.2 m / 4 ft here
- A ledger needs proper fastening and flashing
- Stairs must meet OBC rise, run and handrail rules
- Zoning setbacks and lot coverage still apply
What if my lot backs onto a creek or ravine?
Properties near creeks, ravines, valleys or shorelines may be regulated by a conservation authority in addition to the municipality. In Hamilton that is typically the Hamilton Conservation Authority; in Burlington and Oakville it is typically Conservation Halton. Check with the authority before designing, because a separate permission can be needed and can affect deck location and footing placement.
What do deck permit drawings usually show?
Municipalities want enough detail to confirm the deck is safe and fits the lot. We prepare drawings and handle the application where a permit is required.
- Site plan with property lines, setbacks and deck location
- Deck size, height above grade and stair locations
- Footing type, size, depth and spacing
- Beam, joist and post sizes and spans
- Ledger attachment and flashing, or freestanding framing
- Guard height, openings and handrail details
